Conservation Commission
Meeting
May 20, 2004

Hank Langstroth Acting Chairman, Katherine Roth, Janet Dunlap and Stephen Cremer were the members present. Peter Holden arrived at 8:05 p.m.

7:45 p.m., Discuss Hauserman property purchase:

The Commission agreed to purchase the Hauserman 3 ½ acre parcel on 5 Manor Lane provided that additional private funds are collected so that all the back taxes owed to the Town are paid including FY'2004. This will insure that the Hauserman's net a $9,000.00 profit, which is a condition to proceed with the purchase.
Hank called for a motion for the Commission to pay up to $3,000.00 for the FY'2004 unpaid taxes on the 3 ½ acre parcel and to utilize private funds from either the Friends of Conservation or the Land Donation Account for the remaining balance of the taxes owed to the Town.
Stephen Cremer moved. Janet Dunlap seconded. Voted. 4-0-4.

8:00 p.m., N.O.I. Hearing Continuance, filed by Herb Chambers of Sharon, LLC, for the proposed redevelopment of an existing gravel pit as a full service auto dealership at 15 & 55 General Edwards Highway, DEP # SE-280-454:

Rick Merrikin, an Engineer from American Engineering represented the Applicant. Attorney Joel Fishman appeared before the Commission. Abutters were also present. (See attached list).

Rick Merrikin presented revised site plan dated 4/23/04 to the Commission. Rick explained to the Commission that the drainage system design is not yet completed due to the revised layout of the building. The entrance to the proposed facility has been relocated to the middle of the building. The height of the lower level of the building has been lowered; it is now located 21 feet from the first floor of the facility. Many retaining walls were eliminated to provide more green space around the perimeter of the proposed facility. An installation of an earthen berm is proposed in the vegetated area at the rear of the property and a row of tree plantings is proposed to provide a screening of the parking area from the adjoining properties.
A proposal to be submitted on a revised plan for a gasoline pump installed below grade near the service area of the facility.
The proposed storm water drainage system to be designed for a 100-year storm.
Greg recommended the following:
The installation of settling basins to divert the high water flow away from the brook.
The submittal of a maintenance plan for the proposed leaching basins.
Proposed plans for preventing silt from leaking onto the property.
Rick stated that perhaps a water quality swale could be built in the channel of the stream to collect any silt from seeping onto the site.
Rick Merrikin answered various questions from abutters relating to the proposed drainage, exterior lighting and parking design for the facility.
Rick explained to the abutters that they may request a copy of the proposed drainage design after the Town Engineer has approved the plan.
Abutter Robert Higgins stated that during the month of December 2003 he noticed that the stream on the site was wet contrary to the engineer's statement in the N.O.I. that it was dry during that month.
Rick Merrikin said that he would obtain an affidavit from the Sansone Bros. regarding their historical views on the stream.
Attorney Joel Fishman requested that the Commission draft a letter to the ZBA stating their position
regaridng the proposed project.
Hank called for a motion to continue the hearing until June 17th.

8:50 p.m., General Business:

Goodband Property - Edge Hill Road Wetland Review
Mario DiGregorio, wetland consultant, has confirmed Greg's delineated wetland lines on the proposed site. AvalonBay Communities is in agreement with the consultant's determination.

Glendale Village - Soil Testing Program
Greg explained to the Commission that Norwood Engineering has requested the Commission's approval to perform soil testing within the 100' Buffer Zone, for determining flood mitigation and fieldwork at the proposed 40-B site.
The DEP Wetland Protection Act exempts testing activity within the 100' Wetland Buffer Zone.
Norwood Engineering would develop a protocol to include hay bale barriers on the low side of the excavation are and/or hay mulch over the disturbed test pit surface.
The Commission agreed that the Applicant should submit a proposal for the Commission's review.
